Besides the exceptions, it appears that the courts in some cases felt that the à ¢Ã¢â€š ¬Ã…“prima facieà ¢Ã¢â€š ¬Ã‚  test worked better and in Fellowes Son v Fisher[21] Browne LJ was particularly concerned that it was not possible to consider the balance of convenience fairly and equitably without taking into account the merits of the case[22]. On another note, Meagher argued that it is doubtful that the damages can actually be adequate in cases where the remedy of injunction is sought[23]. Indeed, the injunction is generally applied for in specific, sometimes extreme, cases to prevent the applicantà ¢Ã¢â€š ¬Ã¢â€ž ¢s potential hardship, undermining of its reputation, loss of its customersà ¢Ã¢â€š ¬Ã¢â€ž ¢ trust or loss of its business relationships and it is hard to imagine how the damages can be adequate if any of the above happens. Again, this should all be left to the courtà ¢Ã¢â€š ¬Ã¢â€ž ¢s discretion in order to allow it to do what is just and equitable. Recent considerations Since the introduction of the Civil Procedure Rules and the ensuing change of approach towards the case management, it is claimed that the Cyanamid test is not as critical as it once was, mainly because the Rules place, among other things, greater emphasis on identifying and resolving issues likely to go to hearing as early as possible[24]. In addition, following the implementation of the Human Rights Act 1998, the court in Cream Holdings Ltd v Chumki Bannerjee The Liverpool Daily Post Echo Ltd[25] held that the Cyanamid test is no longer applicable to injunction a pplication relating to the freedom of expression[26]. Conclusion The Cyanamid test is a good example of the battle happening in the courts on the most equitable methods to be used to decide the interim injunctionà ¢Ã¢â€š ¬Ã¢â€ž ¢s application, which are generally either on the merits of the case (the prima facie case) or on the balance of convenience (the serious question). It was argued that some bits of the Cyanamid test were considered too rigid and limiting the courtà ¢Ã¢â€š ¬Ã¢â€ž ¢s discretion in doing justice. As a result, whilst the Cyanamid test was acknowledged and in some cases followed by the courts, it has been frequently either avoided or subject to various exceptions, altogether with ensuing criticism and academic debate. Following the introduction of the Civil Procedure Rules, the Cyanamid test seem to have lost its edge and the Human Rights Act 1998 disapplied its application to the cases involving freedom of expression. However, at the end of the day, the Cyanamid test should not be treated à ¢Ã¢â€š ¬Ã…“as rules but only as guidelinesà ¢Ã¢â€š ¬Ã‚ [27]. As such, they seek to bring more flexibility rather than limit the discretion given to the court by equity (R v Secretary of State for Transport, ex parte Factortame Ltd[28]). Macbeth of William Shakespeares Macbeth and Anakin Skywalker of George Lucas Star Wars series are two men who grow up with great potential, becoming idolized warriors of their own story, eventually coming across a foul way to make their selves greater, and after taking one bad turn they lose themselves completely becoming savage tyrants and abusing their power beyond belief. These stories are similar in this sense along with many other symbols like decapitation, prophecies, the devils role, and loss of innocence. Macbeth emerges as a bold and noble hero, accompanied by his partner, Banquo, the already successful warrior is introduced in a vicious battle between the kingdom of Scotland and the traitor, Macdonwald, and his army. Macbeth engages in battle with Macdonwald, eventually defeating him. When he returns home he is celebrated as a war hero and is given Macdonwalds former title, thane of Cawdor. Revenge of the Sith ? also opens with a battle, in which Anakin Skywalker and his master Obi-Wan Kenobi attempt to rescue the captive Chancellor of the Republic, Palpatine. When they are faced by Count Dooku, the holder of Palpatine, Obi-Wan is injured by the Count and Anakin must fight him alone. Anakin succeeds in his task as Macbeth succeeds in his and both men proceed to decapitate their opponent. Anakin is also rewarded for his deeds when he returns hom e, becoming a representative of the Jedi Council. Because of the evil doings they commit, Macbeth and Vader are now firmly established as true villains. When MacDuff learns of the atrocities Macbeth has placed on his castle he is infuriated, proceeding to Scotland with his army behind him. This time Macbeth is without his wife, Lady Macbeth, who has previously given him a type of courage to go through with his vicious attacks, this gives the scene a different vibe, a feeling of absence to the King. Still, Macbeth is not afraid of the MacDuff or his army as he truly believes he is invincible to anyone born of women, due to the second set of prophecies laid by the weird sisters, he takes on MacDuff with this in mind. However, it is later revealed that MacDuff was born of a Caesarian section and was torn from his mothers womb. MacDuff proceeds to attack Macbeth, eventually defeating the beast and decapitating him. In Vaders final scene he goes out much more respectfully, by overthrowing his master, Palpatine, and tossing him into a bottomless pit. Vader then reunites with his son Luke, releases his helmet, and dies. Suriname Essay In this essay I will compare and contrast the approaches and goals of Richard and Sally Price and S. Allen Counter and David Evens on the topic of Maroon arts of the Suriname. I will explain how they present their findings. And tell what I think they would say the most important discovery or confirmation is. After all of this is done I will do follow up art historical research in the same area. The main focus of my research would be why anyone would be interested in finding out more about this particular regionfs art. The calabash maroon arts would be the art form I would research (relying on the experiences of the authors), giving a brief description of the research I would undertake. I will provide information on how I got the much-needed information about this art form. Also stating if I talked to anyone and why. Lastly describing what questions I would want answered if any. First, I would like to talk about the approach that Sally and Richard Price had when doing their research on the Maroon arts of Suriname. I believe the Pricefs approach was to answer what they called what is undoubtedly the most difficult, politically charged and hotly debated aspect of the study of these arts: their deep culture-historical roots. The Pricefs went to Suriname to do research on these archeological people to find out if these Maroon art works such as calabash bowls were truly African in origin, or if they have other sources that have provided an influence on them that is far beyond Africa. There was a re-emergence in the Maroon arts thatfs unexplainable to many scholars that have studied them. The Pricefs term this as a gunique balance of continuity-in-changeh. What this term means is, they feel there was a lack of documentation during these times and the arts where always around and there was no disappearing act. Counter and Evens went to Suriname find Africa. They believe that Africa and the Suriname Maroons have a direct connection other than being of African decent as far as the arts are concerned. I believe both the Pricefs and Counter and Evens had the same goals in mind, which was to find answers. To find out the unknown of these arts of the maroons, but their intentions were totally different. Like I stated earlier, Counter and Evens wanted to find Africa. The Pricefs wanted to study the fact that the arts are not African but of there own, something new. It is safe to say Suriname is mixing pot of African cultures. And the Pricefs explain that there was a geographical spread of African slaves that were sent to the gNew Worldh. You have many different people coming from all over the West Coast of Africa. The Maroons are escaped slaves who fled in the deep jungles of Suriname. When they were left alone in the jungles the maroons had to create a new way of living and so came new cultural experiences. With a new way of living came a new way to communicate with each other. The Maroons created a new language called Creole. Slavery stripped the former free people of their land called Africa. So many things had to be created a new in order for survival, such as the arts. This gave right to the Pricefs to say that, the culture and the arts that come within started in the interior of the Suriname jungles. The Prices say there is a cultural core that was developed on the plantations and with the Amerindians. A good example of this is the origin of the calabash bowls, which is said to be of Amerindian descent. But as it is told in Maroon tradition it is something of there own, not giving way to the originators which proves a point of the Pricefs saying yes the art and culture are of African influences but they do have an outside presents. However, Counters and Evens, debate the fact that yes, the Maroons were out of their native land but by them being isolated deep within the jungles they were not effected by the outside world at first. They say they were able to keep the African traditions and cultures alive. The only reason some of the rituals were changed was do to the evolution of time. Everything must change, just as you see our American Constitutio n need amendments. Like in the Counter and Evens Film I Sought My Brother, a dance that was being done was changed. I believe it was when the men were doing a dance that involved the use of knives. My I please hand up my written submission Bart Brown, my client's employer, drove my client in a tractor he was fully aware was not safe and by doing this Mr Brown completely disregarded the duty of care he owed to my client. A crash was caused by the colliding of the tractor and the Ms Fiona Fair's vehicle. This breach of duty on Brown's behalf led to the serious injuries endured by my client, in which he is still now recovering from. Mr Brown owed my client a duty of care as the proximity of their relationship grants such, as employer to employee. In O'Connor v Commissioner for Government Transport [1954] HCA 11, the Court held that an employer owes a duty to take reasonable care for the safety of its workers "by providing proper and adequate means of carrying out his work without unnecessary risk..." The neighbour principal can validate this, as a neighbour is a person/s who are so closely and directly affected by the defendant's actions or omissions that he ought to responsibly have had them in contemplation. This principal was established was in the Donoghue v Stevenson (1932) AC562 by Lord Aitken. Now that an establishment has been made of the duty of care Brown owed to my client, I will prove how this responsibility was breached. The Civil Liability Act Section 9 states that In deciding whether a reasonable person would have taken precautions against a risk of harm, the court is to consider the following, the probability that the harm would occur if care were not taken, the likely seriousness of the harm, the burden of taking precautions to avoid the risk of harm, the social utility of the activity that creates the risk of harm. The defendant although aware that the vehicle was unregistered, uninsured and had faulty brakes he still put my client in a position where there was a high risk factor for an accident. The fact that this vehicle was clearly not road worthy poses as a greater likelihood for injury, which is reasonably foreseeable. I don't doubt that it would have been costly to fix the tractor however anyone in that vehicle at anytime is at high risk of resulting in an accident including the defendant, therefore servicing, registering and insuring the vehicle would have been in everybody's best interest. In Bankstown Foundry Pty Ltd v Braistina (1986) HCA 20 where the employee was injured whilst working the decisions was granted that "The common law requires no more of an employer than that he take reasonable care for the safety of his employee." Much like this case Brown was ultimately responsible for Mr Knight's safety, which he neglected to do resulting in the injuries, my client faces today. It is evident that Mr Brown had a Duty of Care for my client; he breached this duty of care and now the third element of negligence, causation. The 3 elements of causation are: 1. Damage was suffered, 2. The damage was caused by the defendant's negligence and 3.the damage was not too remote from the defendant's actions. Firstly, Damage, as a result of the crash Mr Knight has endured a fractured collarbone, a broken right leg and torn ligaments in his right hand. These damages would not have been caused if it were not for the crash caused by Mr Brown's negligence for not making he vehicle safe. The defence may argue that Brown wasn't necessarily the cause of the accident as if it wasn't for Ms Fair's misjudgement of intersection the crash would not have taken place. However, if the tractor's brakes were working properly the accident would have been avoided.
